(ii) Your breach or non-performance of terms of the User Agreement;
(iii) Violation of Privacy Policy;
(iv) Violation of any other Policy;
(v) infringement, or infringement by any other user of your account with Karviich.in;
(vi) Your violation of any law, rules or regulations or the rights including infringement of any intellectual property of any third person or entity.
We shall notify you promptly of such claim, loss, liability, damages, costs, expenses or demand which You shall be liable to indemnify Karviich.in against. You will then be required to consult with Us regarding the course of action to be undertaken in defending such a claim. Furthermore, You shall not compromise or settle any claim or admit any liability or wrongdoing on the part of Karviich.in without our express prior written consent which can be withheld or denied or conditioned by us at our sole discretion.
9. TERMINATION
Karviich.in may suspend, terminate or revoke your use of the website and its services, if it believes, at its sole and absolute discretion that you have breached, violated, infringed, abused, manipulated or exploited any of the terms of the agreement. Notwithstanding anything contained in this clause, the terms of the agreement shall survive indefinitely unless Karviich.in chooses to terminate them. If you choose to terminate the use of the website or in case Karviich.in suspends, terminates or revokes your use of the website and its services for any reason as above mentioned in this clause, your transactional details may be preserved by Karviich.in for the purposes of tax and regulatory compliances. If Karviich.in terminates your account for any breach of the terms of the agreement, any loyalty or reward points earned by you shall stand forfeited. Returns or Refunds for such User shall be at the sole discretion of karviich.in
10. SEVERABILITY
If any clause of the User Agreement shall be deemed invalid, void or for any reason unenforceable, such clause shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses of the Agreement.
11. LIMITATION OF LIABILITY
We will not be responsible or liable for any special, incidental, indirect or consequential damages of any kind in connection with this agreement, even if we have been informed in advance.
12. WAIVER
Any failure or delay to enforce or exercise any provision of the Agreement, or any related right or failure or delay to respond to a breach by a User, shall in no way imply a waiver of Karviich.in’s right to subsequently enforce any provision of the terms of the Agreement or to act with respect to similar breaches by a User or Users.
13. APPLICABLE LAWS AND JURISDICTION
The use of our website and the product purchase contracts through the said website shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of courts, Tribunals, forums at New Delhi. All disputes will be subject to arbitration at New Delhi, Delhi in accordance with the Arbitration and Conciliation Act, 1996. The arbitration proceedings shall be conducted in the English language only.
If any dispute arises between you and Karviich.in, during your use of the website or thereafter, the dispute shall be referred to a sole arbitrator who shall be appointed by us. The award passed shall be final and binding on both the parties. 14. At Karviich , we strive to provide the best fashion experience to our customers. This policy is framed in accordance with the Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020.
1. Return Window Customers may request a return within 7 days from the date of delivery of the product.
2. Eligibility for Returns Products are eligible for return only if: The item is unused, unworn, unwashed, and in original condition Original tags, labels, and packaging are intact The product is returned with the original invoice/order ID.
3. Non-Returnable Items For hygiene and safety reasons, the following items are non-returnable and nonrefundable, unless received damaged or defective: Innerwear, lingerie, swimwear, socks, masks Customized or made-to-order products Products marked as “Final Sale” / “Non-Returnable” at the time of purchase.
4. Valid Reasons for Return Returns will be accepted for: Wrong product delivered Damaged or defective product Size or fit issues Product significantly different from description Minor color variations due to lighting, photography, or screen settings are not considered defects.
5. Return Process Return requests must be initiated via My Orders or by contacting customer support within 7 days Once approved, the product must be handed over to our reverse pickup partner or shipped as instructed All returns are subject to quality inspection upon receipt.
6. Refund Policy Refunds are processed within 7–10 business days after the product passes quality check Refunds will be credited to the original payment method For Cash on Delivery (COD) orders, refunds will be issued via bank transfer or store credit.
7. Shipping & Handling Charges Reverse pickup or return shipping charges may be deducted from the refund, except in cases of defective or incorrect products Original shipping charges are non-refundable, unless required under applicable law.
8. Exchange Policy Exchanges are subject to product and size availability If an exchange is unavailable, customers may opt for a refund or store credit.
9. Damaged / Defective Products If a product is received damaged or defective: Customers must notify us within 48 hours of delivery with clear images A full refund including shipping charges will be provided upon verification
10. Order Cancellation Orders can be cancelled before dispatch for a full refund Orders cancelled after dispatch will be treated as returns once delivered.
11. Consumer Rights This policy does not limit any rights available under Indian consumer laws. Customers are entitled to all statutory protections under applicable regulations.
